1. Who these Terms are between
These Terms of Service ("Terms") form a binding agreement between SUPERDARKCODE LABS (Pvt) Ltd, a company registered in Zimbabwe and the operator of the GoFasta ride-hailing platform ("GoFasta", "we", "us"), and you, the user ("you"). By creating an account, you confirm you are at least 18 years old and able to enter a legally binding contract.
2. What GoFasta is — and is not
GoFasta operates an aggregator marketplace: a platform on which independent drivers and riders find each other and agree to a transportation service directly. GoFasta does not provide transportation services, own vehicles, or employ drivers. Drivers are independent contractors who operate their own businesses and are solely responsible for the rides they provide.
When you book a ride, the transport contract is between you and the driver. GoFasta facilitates, but is not a party to, that contract.
3. Your account
- You must provide accurate information when you sign up and keep it up to date.
- You are responsible for everything that happens under your account, including the safekeeping of your password and verification codes.
- You must not share your account, sell it, or let anyone else use it.
- We may suspend or close accounts for fraud, repeated safety violations, non-payment, or material breach of these Terms.
4. Fare, payment and platform fees
4.1 How the fare is determined
Riders propose a fare. Drivers accept or counter. Once both parties tap accept, the fare is locked for that trip. There is no surge pricing.
4.2 No per-ride commission
GoFasta does not charge a per-ride commission. The full agreed fare is paid to the driver. We do not deduct a service percentage from the fare, and no such deduction appears on any receipt.
4.3 Escrow-backed payments
All non-cash payments are placed into an escrow account held by our licensed payment processor at the moment a ride is booked. Funds are released to the driver when the trip is marked complete. If the driver fails to arrive, the rider cancels within the allowed window, or a dispute is resolved in the rider's favour, the full amount is returned to the rider, typically within 48 hours.
4.4 Driver platform access fee
In place of a per-ride commission, active drivers pay a platform access fee, billed periodically, that covers onboarding and verification, the escrow-backed payments infrastructure, 24/7 support and safety operations, and ongoing product development. The current amount, billing frequency, and payment method are disclosed in the Driver app during sign-up and at renewal. The fee may change with no less than 30 days' written notice to affected drivers, at which point any driver may choose to cancel their subscription and deactivate their account without penalty. The platform access fee is never deducted from a rider's fare.
4.5 Payment methods
Supported rider payment methods include EcoCash, OneMoney, InnBucks, Visa, Mastercard and cash. Non-cash methods are settled through the escrow flow above. Cash payments are settled directly between the rider and the driver at the end of the trip.
4.6 Refunds and adjustments
If you believe a charge is wrong, open the trip in the app and tap Dispute. We respond within 24 hours and, where we agree, refund the disputed amount to your original payment method within 48 hours.
5. Conduct rules
You agree you will not:
- Harm, threaten, harass, or discriminate against any person on the platform.
- Damage a driver's vehicle or transport illegal goods.
- Use the platform to commit or assist in a crime.
- Submit false documents or impersonate another person.
- Attempt to reverse-engineer, scrape, or interfere with our software or servers.
- Circumvent the platform's payment flow (for rides sourced on-platform) in a way that avoids the driver's platform access obligations.
6. Drivers: independent contractor status
Drivers are independent contractors, not employees, partners, agents or joint venturers of GoFasta. Drivers:
- Decide when to be online, which offers to accept, and what routes to take.
- Are responsible for their own vehicle, insurance, licensing, and tax.
- May work on competing platforms without restriction.
- Retain the right to organise collectively and will not be penalised for doing so.
7. Intellectual property
The GoFasta name, logo, app, website and all related content are owned by GoFasta and protected by copyright and trade mark law. We grant you a limited, non-exclusive, revocable licence to use the app and website to access the service. You may not copy, modify, or create derivative works without our written permission.
8. Liability
8.1 Our role
Because GoFasta is not a transport provider, we are not responsible for what happens during a trip. Drivers are responsible for the safety of their vehicles and the conduct of their rides. We work hard to keep unsafe operators off the platform, but we cannot guarantee any particular outcome.
8.2 Limitation
To the maximum extent permitted by Zimbabwean law, our total liability to you for any claim arising under or in connection with these Terms is limited to the total platform access fees you have paid to GoFasta in the 12 months preceding the claim (or USD 50, whichever is greater). We are not liable for any indirect, consequential, special, or punitive damages.
8.3 What this does not affect
Nothing in these Terms limits any liability that cannot be excluded or limited by law — including for death or personal injury caused by our negligence, or for fraud.
9. Insurance
Drivers are required to maintain valid third-party motor insurance in Zimbabwe. GoFasta provides a supplementary trip-linked passenger-injury cover for every completed trip, capped at amounts published in the app under Settings → About → Insurance summary.
10. Termination
You may close your account at any time from Settings → Account → Delete account. We may close or suspend your account where we reasonably believe you have seriously or repeatedly breached these Terms. Where safety is at stake we may suspend immediately and explain afterwards.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we announce the change at least 14 days in advance (in-app and by email) and post a diff of what changed. If you disagree with a change, you can close your account before it takes effect.
12. Governing law and disputes
These Terms are governed by the laws of Zimbabwe. Any dispute that cannot be resolved with our support team will be referred first to mediation, and failing that, to the exclusive jurisdiction of the Zimbabwean courts.
